1. Agreement
These Terms govern access to Comms by Osis, including the Whop app, dashboard, messaging automation, trials, integrations, and related services operated by Osis LLC. By installing, connecting, clicking to start a trial, or using the service, you represent that you are authorized to bind the business or workspace you manage.
2. Customer Responsibilities
You are responsible for your Whop community, products, offers, Creed instructions, claims, pricing, promotions, member lists, consent to message members, and compliance with laws and platform rules that apply to your business. Comms may generate or send messages based on your configuration, but you remain responsible for the accuracy, legality, and suitability of what your agent is instructed to say.
3. Messaging Consent
You authorize Osis LLC and its providers to process member/contact data and send automated iMessage, SMS, email, or related communications on your behalf where enabled. You must have all permissions, consents, notices, opt-in rights, and lawful bases required to contact each recipient. You must honor STOP, unsubscribe, wrong-number, and do-not-contact requests.
4. Trial and Suspension
Whop app trials run for the displayed period, currently 4 days unless otherwise stated. When the trial ends, Whop messaging automation may stop until the workspace is upgraded. Osis LLC may suspend or limit access for expired trials, failed billing, abuse, compliance risk, security risk, or use that could harm users, recipients, platforms, providers, or Osis LLC.
5. Prohibited Use
You may not use Comms to send unlawful, deceptive, harassing, discriminatory, exploitative, spam, phishing, malware, or rights-infringing content. You may not use Comms to make unsupported claims, guaranteed outcomes, misleading financial or betting promises, medical/legal/financial advice without proper authorization, or statements that violate platform, carrier, Whop, Apple, messaging, or advertising rules.
6. AI and Automation
Comms uses automated systems that can make mistakes. You must test, review, and configure your Creed and connected knowledge before going live. Osis LLC does not guarantee that AI output will be error-free, compliant for your industry, or suitable for every recipient. You are responsible for monitoring conversations and correcting, pausing, or updating your agent when needed.
7. Data and Integrations
You authorize Osis LLC to connect to selected third-party services, including Whop and messaging providers, using credentials, tokens, webhooks, and APIs you approve. You are responsible for maintaining your third-party accounts and permissions. Third-party services may change, fail, rate limit, reject, delay, or block messages, and Osis LLC is not responsible for third-party outages or policy decisions.
8. No Warranties
The service is provided as is and as available. To the fullest extent allowed by law, Osis LLC disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, deliverability, conversion results, revenue impact, compliance outcome, or accuracy of generated content.
9. Limitation of Liability
To the fullest extent allowed by law, Osis LLC will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost profit, lost revenue, lost data, business interruption, deliverability, carrier, platform, or compliance damages. Osis LLC's aggregate liability is limited to the amount paid to Osis LLC for the service during the 3 months before the event giving rise to the claim.
10. Indemnity
You agree to defend, indemnify, and hold harmless Osis LLC from claims, losses, liabilities, penalties, fees, and expenses arising from your business, products, claims, Creed, content, recipients, consent practices, use of Whop/member data, breach of these Terms, or violation of law or third-party rules.
11. Changes
Osis LLC may update these Terms from time to time. Continued use after an update means you accept the updated Terms. Material updates may be communicated through the product, website, or another reasonable channel.
